About Our Panelists:

John L. Hackett, Jr. - Hackett Feinberg. John Hackett’s practice includes the representation of banks and other financial institutions in connection with both commercial and commercial real estate credit arrangements. His experience ranges from smaller loan transactions to sophisticated multi-borrower and multi-lender transactions involving both typical and unusual collateral in Massachusetts and other domestic and foreign jurisdictions. John also works with creditors in asserting and exercising their rights and remedies under financing transactions including foreclosure and disposition of collateral, and negotiation and documentation of forbearance, restructuring and settlement agreements. John also frequently represents privately owned businesses in debt and/or equity financings and other transactions, including both sales and acquisitions of businesses and other business transactions.

John has been a lecturer for the New England Banking Institute, Robert Morris Associates, the Eastern Association of Equipment Lessors and other trade association and industry training organizations. Prior to undertaking the practice of law on a full time basis, John managed the commercial loan review function for a large regional commercial bank. Prior to that, he was a principal bank examiner for the Massachusetts Division of Banks.

Paul Flynn, Jr. is Chief Operating Officer of BDC as well as President of New England Certified Development Corp., the company’s SBA 504 lending affiliate.  Mr. Flynn’s role includes strategic development and oversight of both internal operations and new business development throughout New England. His experience includes over 25 years of lending to the New England business community.

Prior to joining BDC Capital, Mr. Flynn served as Regional Leader and SVP ABL Dept. Manager & Commercial Lending at Berkshire Bank, ABL Department Manager of TD Bank, and Senior Vice President of Banknorth.  Mr. Flynn began his banking career at BayBank in 1986. He received his undergraduate degree from Fairfield University and a MBA from Babson College.

Mr. Flynn is a member of the National Commercial Finance Association and the Association for Corporate Growth, and is a Past President of the Turnaround Management Association’s Northeast Chapter

Jim Shulman is Senior Credit Officer at Boston Private Financial Holdings and Manager of Special Assets Group (SAG) at Boston Private. Jim worked in conjunction with the risk management team to implement heightened policies, procedures and controls at the company's banks. He instituted quarterly on sight portfolio review processes to identify portfolio weaknesses.Jim managed the development and implementation of action plans and timelines for the resolution of the Bank’s criticized assets in fourteen regions across the country.

Jim received his MBA from Babson and BA from Syracuse. He is a 27-year Pan MA Challenge rider, board member and current treasurer.

Foster Fegarsky is Head of ABL Field Examination at TD Bank with 30+ years of Commercial Lending Experience including 20 years of ABL and Factoring Collateral Field Examination, encompassing Vice President, Senior Vice President and Manager position’s at TD Bank, GMAC Commercial Finance and Deloitte & Touche, LLP, respectively. Prior to joining TD Bank, as the Head of ABL Field Examination, he served as SVP of Field Examinations for the Commercial Services Group at GMAC Commercial Finance.  At the various stops in his career, Mr. Fegarsky has been instrumental in developing and implementing new policies and procedures. He has also managed all New Business and Troubled Asset examinations. Prior to Collateral Field Examination, Foster held positions with CIT and HSBC (Republic Business Credit).
 
In addition to his field examination duties, Foster has been involved with TD Bank’s Risk and Controls Group as the Asset Based Lending Business Line Liaison since October 2012.  In that role, Foster has been the point person for all internal controls, Privacy, AML and compliance issues for the Asset Based Lending Group.

Wayne Gniewkowski is a Principal of Crowe Horwath LLP, with over 14 years of experience in the Risk Consulting practice servicing the financial services industry. Wayne is responsible for managing full scope and co-sourced internal audit and Sarbanes-Oxley Section 404 engagements for operational, compliance and information technology controls. His clients have ranged from denovo financial institutions to multi-billion dollar financial institutions and bank/multi-bank holding companies up to $600 billion. Wayne is primarily responsible for annual engagement planning, client communications, engagement team coordination, and overall technical and quality assurance for engagements. He works closely with the engagement team on final client deliverables, as well as Audit Committee communications and deliverables. Wayne received his degree in finance from the University of Toledo.
